A court judgement in the case of an accident caused by the negligence of a forklift truck driver, who had furnished fake papers to secure a job, has raised the issue of stringent verification of all operators handling heavy and sensitive equipment. The Health and Safety Executive (HSE) has now issued a caution to all employers to take special care to verify the credentials of all prospective employees.

The accident occurred on October 10, 2007 when telehandling machinery was being used to unload a wooden house kit from a lorry at a construction site in Livingston, West Lothian. Damon Alex McLachlan, the telehandler operator, failed to follow basic precautionary procedures and did not use stabilizers to unload the three-ton material. As a result, the heavy load came crashing down from the forklift to hit a banksman who was standing nearby. The banksman sustained serious injuries in the accident.

An HSE investigation into the accident revealed that the forklift operator had been working on the site for only a few weeks. It was also found that he had produced partly fake documents to prove his experience and training in order to secure the job.

The HSE dragged McLachlan to court charging him with the breach of Section 7 of the Health and Safety at Work etc Act 1974. Livingston Sheriff Court ordered him to pay a fine of 500 pounds after he pleaded guilty to the charges.

Talking about the incident, HSE Inspector Bruce Monaghan said the accident could have been avoided by following the basic safety mechanisms and the use of stabilizers. He called upon employers to ensure that all workers follow operating instructions diligently. Furthermore, he urged employers to cross check the experience and qualifications of potential employees.

When such simple precautions are omitted, incompetent and unskilled workers are erroneously employed leading to such tragic accidents at the workplace, added Monaghan.

James Gordon, a 63 year-old employee of EDF Energy Contracting Ltd, died on August 2, 2007 after falling from a height of over five meters while on duty. He was dismantling a mobile tower scaffold in the sports hall of Worthing High School in West Sussex, when he fell off the platform and suffered serious head injuries. There were no handrails on the scaffold platform he was standing on and this cost him his life.

Gordon is survived by a window and several grandchildren, and he still had about two years to go in his employment.

The Health and Safety Executive (HSE) filed a lawsuit against the company in Chichester Crown Court, charging it with the violation of regulations 4b and 4c of the Work at Height Regulations 2005. The company accepted its liability and agreed to pay a fine of 160,000 pounds. The court also ordered EDF to pay the costs of the suit, amounting to 24,594 pounds.

Emphasising the need for proper height safety measures for workers, HSE Inspector Russell Beckett said the employers must make sure that scaffolds have handrails to protect workers from falling while they are working. He said guard rails must be at least 950 mm high. Beckett also emphasized on the need of intermediate guard rails to prevent workers from falling through the gaps.

The latest statistics by the TUC reveal that since the onset of recession in the UK, the amount of unpaid overtime has actually gone up with almost 5 million employees putting in about 7 hours of extra work each week without being paid for it.

The maximum effect is being felt by employees in finance, public administration and the R&D sectors, where almost a third of the total employees have to put in unpaid overtime.

Agricultural workers, tool hire workers and garage workers are feeling the heat too, with an average unpaid overtime increase of 13 days, 7 days and 5 days respectively.

Brendan Barber, the TUC General Secretary says that the recession is clearly influencing both business owners and their employees. The employers are trying to minimize their costs in their struggle to survive, and employees fearing for their job are not in a position to complain against overtime. The odd thing is that although workers in some industries have to put in extra time without pay to complete their assignments, there are those in other industries who barely have sufficient work in their usual hours. He also emphasised on the need of rationalising the work being assigned to the employees to ensure that unpaid overtime is not being wasted on unnecessary work. He is against the long hours culture, stating that organisation should not develop a system which encourages long hours through a tacit understanding that the person leaving last will also be the last to be laid off.

One often-overlooked asset of your business is the testimonials you receive from happy, satisfied customers. Most businesses receive favorable customer comments and testimonials, but few translate these powerful marketing weapons into additional sales.

Testimonials work because customer comments are more credible than your words. When you say something about your business, your words are viewed as claims. But when your customer says them, their words are viewed as truth.

When a customer says something nice about you, your business, or one of your employees, how you respond is critical. Customer testimonials come in many forms, including conversations, emails and letters. Few testimonials are ready-to-use, however. Most can benefit from a little effort before you can put them to work.

Although you may receive testimonial letters that include permission to use the customer’s words and name, in most cases you’re best off contacting the customer, verifying the quote and asking permission to use their words and their name.

This is especially true if you are going to quote from a conversation or an email. Customers will appreciate your integrity. More important, verifying gives you a chance to clean up the customer’s grammar and also improve upon the customer’s original quote. For example, when verifying (or rewording) their comments, you might also ask: “Were there other aspects of buying from us that you might care to comment on?”

Simply showing an interest in the customer’s words is often enough to open the testimonial floodgates.

Here are five ways to get the most from your testimonials:

1. 3-ring binders. Letters and emails tend to get lost. One of the best ways to prevent this is to immediately place the original in transparent sleeves stores in a 3-ring binder.

2. Bulletin board. Hang copies on a bulletin board - or better - frame and display them behind glass in a prominent location in your place of business. Use a colored background to highlight the most recent letter you’ve received.

3. Computer file. Save excerpts from customer letters in a special computer file. Enter just the most relevant words along with the customer’s name and city. (Excerpting focuses on the most important parts of the letter.)

4. Copies and printouts. Copy customer letters and insert them in your press kits and customer presentation folders. Format your customer testimonial file and include printouts with proposals.

5. Newsletter and website. Include customer testimonials in your newsletters and on your website. When appropriate, place testimonials next to descriptions of specific products or services.

Whenever possible, include photographs with your testimonials. Many car dealers, for example, photograph customers taking delivery of their new car. Since this is generally a happy time for customers, displays of these photographs project a positive image.

Even better, create posters for display at the point of sale. Simply create a collage of customer comments and photographs professionally typeset and laid out.

Use testimonials as the basis for your firms’ advertising. Nothing beats ads written in your customer’s own words. The ads inevitably attract attention and communicate with credibility unavailable in any other way. Create a variety of ads, reflecting the different marketing segments your business serves.

Thank your customers for their support and time. However, avoid paying customers. This could detract from the credibility of their words. Feel free, however, to show your appreciation with gift certificates or coupons worth savings or discounts.
